Why Illinois costs what it does

  • High medical costs. A slip-and-fall claim is priced on what it costs to treat the injury and defend the case, and both run above the national figure in the Chicago area. That is why general liability, not property, carries most of the gap.
  • The Biometric Information Privacy Act. BIPA lets individuals sue over fingerprints or facial scans collected without written consent, and it has produced large class actions against businesses that use fingerprint or facial-recognition timeclocks. A 2024 amendment limited per-scan damages, but the exposure is still priced into liability rates for any business that runs a biometric device.

What Illinois requires

The Illinois Department of Insurance (IDOI) regulates insurers.
