Why New York costs what it does
New York prices about 39 percent above the national average in our state table, for four reasons.
- New York City’s litigation environment. Juries in the five boroughs award more and cases take longer, and every liability rate in the state carries some of that; a Manhattan or Brooklyn address carries the most.
- High medical and legal costs. A slip-and-fall claim is priced on what it costs to treat the injury and defend the case, and both run well above the national figure here. That is why general liability, not property, carries most of the gap.
- The Scaffold Law. Labor Law sections 240 and 241 hold owners and contractors liable for gravity-related injuries on construction sites with almost no defence. No other state has a rule this broad, and it makes construction liability unusually expensive here.
- More mandatory coverage than elsewhere. New York requires disability benefits and Paid Family Leave insurance on top of workers’ compensation, a fixed cost most other states do not impose.
What New York requires
The New York State Department of Financial Services (DFS) regulates insurers. The New York State Workers’ Compensation Board administers the rule that matters most to a small employer: workers’ compensation is required for virtually every employer with any employee. There is no headcount threshold; the first hire brings the obligation.
